Tocumen Airport sues Odebrecht

The administrator of Tocumen International Airport, in Panama, filed a lawsuit claiming US$20,737,000 from Novonor (which before the 2016 “Operation Car Wash” scandal was known as Constructora Norberto Odebrecht) for damages caused by the construction of Terminal 2.

Raffoul Arab, general manager of Tocumen S.A., pointed out that, for not receiving the works according to the terms of the contract, the company under his charge had to incur several expenses for the purpose of leaving the passenger processing area of the Terminal operational. “CNO has failed to comply with its contractual obligations by not delivering the project within the agreed deadline. This has meant that we have had to incur extraordinary expenses,” said Arab.

The lawsuit also considers damages for the loss of profits caused to Tocumen for the income not received from the rental of commercial premises. In addition, according to Arab, the non-compliance has affected national interests and the airport’s image.

As Sinart points out, Odebrecht began construction of the 116,000-square-meter second terminal in 2016. The work was awarded following a public tender called by the State. The works, a US$679 million contract, were to be completed on September 30, 2021. However, they ended up costing $917 million and, according to Tocumen, were never completed within the timeframe stipulated in the contract.

Shortly before the stipulated completion date, the airport operator announced the termination of the contract, a measure that was rejected by CNO. According to the multinational, the project was 99.9% complete at that time and the building was commissioned in 2020.

Despite the dispute, the terminal has been operational since June and is Copa’s main hub.
